Terms of Service

These Terms govern your use of Sumzy, the AI review-summary product, and the backend service operated from sumzy.io by Flamboyant Flamingos SRL ("Sumzy", "we", "us"). Sumzy is offered on two platforms: as a plugin for WooCommerce and as an app for Shopify. By installing, activating, or using Sumzy on either platform, you ("you", the "merchant") agree to these Terms. If you do not agree, do not use Sumzy.
These Terms apply to both platforms. The shared clauses below govern your use of Sumzy on either platform. Where a clause depends on the platform you use, the platform is named explicitly. The billing terms differ by platform and are set out separately in §8 (WooCommerce billing is handled by Freemius as Merchant of Record; Shopify billing is handled by Shopify as Merchant of Record).
These Terms incorporate the Privacy Policy and the Data Processing Agreement. The Privacy Policy that applies to you depends on your platform: the main Privacy Policy covers the WooCommerce plugin, and the Shopify Privacy Policy covers the Shopify app.
1. The service
Sumzy reads the customer reviews already collected on your store and generates concise, AI-generated summaries to display on your product pages. On WooCommerce, Sumzy reads the reviews already published on your WooCommerce store. On Shopify, Sumzy reads the product reviews you already collect in your connected review provider (at launch, Judge.me). On either platform, summaries are produced by a third-party AI model (Anthropic Claude) from the review text you submit through the plugin or app. Sumzy is a subscription service; some features depend on an active subscription served by our backend.
2. Accounts, subscription, and the entitlement gate
- The Sumzy subscription is managed through your platform's billing system (see §8). On WooCommerce, the subscription and license are managed through Freemius. On Shopify, the subscription is managed through Shopify Managed Pricing, and your plan and billing status are held by Shopify and synced to our backend through Shopify's billing webhooks.
- New AI summaries are served by our backend only while your subscription is active. While your subscription is active, including any period you have already paid for after cancelling and any platform grace window, your summaries display normally on your storefront. A temporary backend outage will not remove them, because your storefront renders from a local copy held on your platform (see §7). If your subscription fully lapses, Sumzy stops generating new summaries and stops displaying existing ones on your storefront. Your stored summary data is not deleted during the post-cancellation retention window described in the applicable Privacy Policy, and rendering resumes if you resubscribe within that window.
- You are responsible for keeping your account credentials, license, and platform account secure, and for activity under your account.
3. Merchant responsibility for published content
This is the central allocation of responsibility, and you should read it carefully.
The AI summary is a tool that helps you describe what your reviewers say. You (the merchant) are responsible for the content published on your store, including any Sumzy summary you display. Specifically:
- You can review, edit, approve, or hide every summary before or after it is shown (Sumzy provides approval and hide controls). A summary you leave published is content you have chosen to publish.
- The summary is disclosed as AI-generated in the widget (an "AI" pill plus a screen-reader "AI-generated summary" announcement), so shoppers know its nature.
- Sumzy does not warrant that a summary is accurate, complete, or free of error (see §6). You are responsible for ensuring the content you publish complies with applicable law (including consumer-protection and advertising rules) and accurately represents your products.
- You are responsible for having the rights to the review content you submit and for handling your customers' data as the data controller (see the DPA).
- If you turn on the optional custom disclaimer and replace its default wording, the disclaimer text becomes your own content. You can edit it freely, subject to a length cap (currently 300 characters) and a non-empty requirement, and you may turn it off entirely. You are solely responsible for what your custom disclaimer says, including whether it is accurate, lawful, and not misleading. Your freedom to set this text is subject to the acceptable-use limit in §4. Sumzy is not responsible or liable for disclaimer wording you author or edit, and it does not review, approve, or endorse that wording. The default disclaimer text Sumzy provides is offered as a convenience, on an "as is" basis, and is not legal advice; if you keep it, you remain responsible for displaying it on your store.
4. Acceptable use
You agree not to:
- submit content you have no right to submit, or use Sumzy to process data unlawfully;
- attempt to reverse-engineer, resell, sublicense, or pirate the backend service or its AI logic, or circumvent the subscription gate, usage limits, or license and entitlement checks;
- use Sumzy to generate unlawful, deceptive, infringing, or abusive content;
- overload, probe, or attack the service, or use it to build a competing summarization service;
- submit content engineered to manipulate the AI model into producing harmful or policy-violating output.
We may suspend or terminate access for material breach of this section.
Use of the merchant disclaimer and other merchant-supplied widget text
Sumzy gives you an optional disclaimer field, and on some surfaces other free-text fields, that display in or beneath the AI summary on your storefront. These fields are provided for a neutral, truthful caveat, for example a short note that the summary is AI-generated and reflects only the reviews submitted. You agree not to use the merchant disclaimer, or any other merchant-supplied text that Sumzy renders alongside the summary, to contradict, disclaim, suppress, downplay, or characterize as resolved or unimportant the AI-generated summary or any complaint, concern, or theme it surfaces, and not to instruct or encourage shoppers to disregard the summary or those themes. The honest, proportional summary is the point of the product. Text that tells shoppers to ignore a recurring complaint the summary surfaces, or that tries to neutralize it, defeats that purpose and may also breach consumer-protection and advertising law that applies to you as the publisher of your storefront. This restriction does not stop you from adding accurate context, from correcting a factual error, or from describing a genuine improvement you have made; it stops only the use of these fields to undermine the truthfulness of the summary itself.
Using the merchant disclaimer or other merchant-supplied widget text in breach of this section is a material breach. We may suspend or terminate access for material breach of this section, and we may do so without first removing the offending text, since you control the text on your own store.
5. Fair use
Sumzy plans are differentiated by features, not by product count. All plans are designed to cover ordinary commercial stores of any catalogue size. To keep the service reliable and fairly available to all merchants, Sumzy applies reasonable backstops against abusive or automated over-use.
What is covered. Normal retail use at any catalogue size is covered. Summaries generate automatically in the background as reviews arrive; the periodic refresh sweep progressively covers your full catalogue. You are not charged per product or per summary for ordinary use.
Fair-use backstops. Sumzy reserves the right to rate-limit requests (returning a 429 response) or temporarily pause generation for a store that generates summary requests at a rate or volume that materially exceeds what a legitimate retail store would produce. These limits exist to protect service quality for all users, not to restrict normal use. If you believe a limit has been applied to your account in error, contact hello@sumzy.io.
Trial generation cap. Free trials include a per-account generation allowance (a good-faith evaluation quota). This cap is stated in the trial terms at activation and enforced server-side. The purpose is to ensure the trial reflects real evaluation, not to restrict production use after you subscribe.
Automated or bulk abuse. You agree not to submit fabricated reviews, loop automated scripts to trigger continuous regeneration, or otherwise use Sumzy in a way that is designed to exploit or circumvent the service limits. Such use may result in suspension.
What this is not. This section does not impose a hard per-product or per-month quota on normal subscription use. It is an anti-abuse provision, not a metering clause. Specific numeric parameters (where applicable) are operational and subject to change without notice; they are not published on public pages. Contact support if you are planning an exceptionally high-volume integration.
6. AI output disclaimer
- Sumzy summaries are generated by an AI model and are provided "as is". We do not guarantee their accuracy, completeness, currency, or fitness for any purpose. AI models can misread, omit, or mischaracterize, and a summary reflects only the reviews submitted.
- Summaries are informational only and are not professional advice of any kind (including not medical, legal, financial, or safety advice). Do not rely on a Sumzy summary for any decision requiring qualified professional judgment.
- Because you control whether a summary is published (see §3), you should review summaries for products where accuracy is sensitive (e.g. health, safety, or regulated claims) before publishing.
- Sumzy applies safeguards to keep reviewer personal data out of summaries and to avoid fabricated content, but these are best-effort and not guaranteed; report any issue to support.
7. Storefront rendering and service availability
By design, your product pages render summaries from a local copy held on your platform, so your storefront stays fast and intact even if our backend is unavailable. The mechanism is platform-specific:
- WooCommerce. Your product pages render summaries from your store's local copy held in your WordPress database. The plugin reads that local copy, so your storefront renders the summary without a live call to our backend on each page load.
- Shopify. Your product pages render the summary from data Sumzy writes into an app-owned product metafield in your Shopify store (namespace
$app, keysummary). Your theme reads that metafield to display the summary, so the storefront renders the summary without a live call to our backend on each page load. The metafield is created and managed by the app and is removed when you uninstall the app from your Shopify admin.
We do not guarantee uninterrupted backend availability for new summary generation; we aim for reasonable availability and may perform maintenance.
8. Billing, Merchant of Record, and trials
Sumzy is sold through your platform's billing system, and the Merchant of Record differs by platform. The terms in this section apply according to the platform on which you subscribe.
Common to both platforms. Plans are offered monthly and annually and renew automatically until cancelled. Plans are differentiated by feature set, not by product count or usage; see the pricing page. The displayed prices are identical on both platforms. A 14-day free trial may be offered; it converts to a paid subscription unless cancelled before it ends, and is subject to a per-account generation cap during the trial. To stop further charges, cancel before your next renewal; you keep access through the period already paid for. Nothing in this section limits any mandatory consumer-law rights you may have.
8.1 WooCommerce billing (Freemius as Merchant of Record)
- The Sumzy WooCommerce subscription is sold by Freemius, Inc. as Merchant of Record. Freemius processes your payment, issues invoices, and handles applicable VAT and sales tax. Your purchase is also subject to Freemius's checkout terms and the Freemius End User License Agreement.
- Refunds and cancellations: Sumzy offers a 14-day money-back guarantee on your first paid charge after a trial converts. Request a full refund of that first charge within 14 days and we will issue it (Sumzy's full refund policy is published at sumzy.io/refunds). Renewal charges are non-refundable except at Sumzy's discretion; to stop further charges, cancel before your next renewal and you keep access through the period already paid for. Freemius, as Merchant of Record, executes refunds, cancellations, and payment-dispute handling under its own policies and your Freemius checkout terms.
8.2 Shopify billing (Shopify as Merchant of Record)
- The Sumzy Shopify subscription is sold through Shopify Managed Pricing, with Shopify as the Merchant of Record. Shopify processes your payment, charges your Shopify account, issues your billing records, and handles applicable taxes. Your purchase is also subject to Shopify's own terms, including the Shopify Terms of Service and the terms shown on Shopify's hosted plan-selection and checkout pages. Sumzy does not process your card data and is not the seller of record for the Shopify subscription.
- Refunds, cancellations, proration, and payment-dispute handling for the Shopify subscription are governed by Shopify's billing policies, because Shopify is the Merchant of Record for this subscription. To stop further charges, cancel or uninstall the app through your Shopify admin before your next renewal; you keep access through the period already paid for. Any refund of a Shopify charge is requested and processed through Shopify under its policies, not through Freemius.
9. Intellectual property
Sumzy and its backend, code, and branding are owned by the Sumzy operator, Flamboyant Flamingos SRL. You receive a limited, non-exclusive, non-transferable license to use the plugin or app and the service per these Terms and your subscription. As between you and Sumzy, the summaries displayed on your store are yours to use on your store; the underlying service and models remain ours or our providers'.
10. Limitation of liability
To the maximum extent permitted by law:
- Sumzy is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
- Sumzy's total aggregate liability arising out of or relating to the service is limited to the amounts you paid for Sumzy in the 12 months preceding the event giving rise to the claim.
- Nothing in these Terms excludes liability that cannot be excluded by law, including mandatory consumer-law rights in your country.
11. Indemnity
You agree to indemnify Sumzy against claims arising from your content published via Sumzy (see §3), including any custom disclaimer or other merchant-supplied widget text you author or edit (see §4), your breach of these Terms, or your unlawful use of the service.
12. Changes, termination, governing law
- We may update these Terms; material changes will be notified and take effect on the stated date. Continued use after that date constitutes acceptance.
- Either party may terminate per the subscription terms; you may uninstall the plugin or app from your platform admin at any time. On termination your right to new summary generation ends, the Shopify app's summary metafield is removed on uninstall, and data handling follows the DPA and the applicable Privacy Policy.
- Governing law and venue: these Terms are governed by the laws of Romania, and the competent courts of Romania have jurisdiction. This does not remove the consumer-protection and GDPR rights that apply to you under your own local law, which continue to apply regardless because Sumzy sells internationally. In particular, if you are a consumer, you may also be entitled to bring proceedings in, and to the protection of the mandatory law of, your country of residence.
